WHAT PERSONAL DATA WE COLLECT / INFORMATION COLLECTION & USE

If you are not a user of Twii, and just browsing our site, only anonymous diagnostic and usage information is collected, no personal information is provided, and no personal information is retained. 

When you register for Twii, you control the personal information you provide us. Twii will require, at a minimum, your name, phone number, date of birth, gender, sex, relative location, and a picture of you. If you do not consent to providing this information, do not sign up for Twii. You may be required to verify the authenticity of your information before you are able to use Twii. Twii may also store other identifiable information entered as you use the application, including, but not limited to, provided personal information including biography, tagline, user photos, interaction and platform message content, using your location in the background, making your profile information available to other users of the platform, supplying your social media information (if provided) with other users of the platform, or other applicable data relevant to the usage of the application. Twii may send you a text message via short message service (SMS) when you sign up, to verify your phone number, or when requested to complete a password reset. Twii will not email you, unless you add your email to your profile, and verify it. Emails will be sent only for user-base wide announcements, and when requested by the user to complete a password reset. Emails collected are used solely for password reset and account verification functionality. Twii will only email you if you have explicitly requested it. We do not send newsletters, notifications, alerts or update announcements via email. 

If you choose to use our Service, then you agree to the collection and use of information in relation to this policy. The Personal Information that we collect is used for providing and improving the Service. We will not use or share your information with anyone except as described in this Privacy Policy.

WHO WE SHARE YOUR DATA WITH & WHERE WE SEND YOUR DATA

Website User Analytics

As a user of the Twii website, no personally identifiable information is collected, but anonymous usage information including pages viewed, page view time, and machine tracking information may be shared with affiliated parties (Google) for the purpose of website statistics collection, usage information, or for security and misconfiguration detection. This includes website visitor information which may be tracked if not disabled by a client-side extension, by Google-based platforms.

Application User Statistics

As a Twii user, your data may be shared with services that are integral to the core function of the application. These services, and their relevant providers, are listed below. Anonymous usage statistics may also be collected from within the application, and made available to affiliated parties at our discretion. When you register for Twii, you consent to this collection and disclosure.

As a user of the Twii web application, you agree and consent to the disclosure of user-related non-identifiable information to display advertisements within the platform, and tailor the displayed advertisements for user relevance. We may disclose information including your age, gender, and interests. We will not disclose your name, location, phone number, or email address.

Your data is not explicitly shared with any third party. Anonymous usage data may be collected in accordance with the above. Historical user data is not retained for market or vendors, and is deleted as space requires.

GOOGLE

Twii uses Google Services for website statistics collection, as an advertisement platform vendor, for application statistics collection, and for application login with your Google Account. Our application also relies on external libraries and software developed by Google, for example;

Your phone number may be sent to Google for additional verification and validation
If you use Google login, we will store a unique identifier on our servers that can be used to identify your Google account
 

APPLE

If you use Apple login, we will store a unique identifier on our servers that can be used to identify your Apple account.

TWILIO

When you register for Twii, or reset your password, your phone number may be supplied to Twilio for verification, SMS message, and user validation purposes.

OTHER

Other users of the platform may have access to the data you enter on your Twii account, in accordance with your settings within the application.

ADVERTISING COMPANIES

If you are a free user of the service, who has not made a purchase through the service, we retain the right to show you ads, which may require sharing your data with advertising companies.  Likewise, if you are a user currently logged in via the web application, regardless of whether you are a free user of the service or not, we retain the right to show you ads. 

OTHER PARTIES

We retain the right to disclose anonymous user base statistic information at our discretion.

We may collect usage information from all users via Google Analytics. This usage information may identify you on repeat visits. 

When you view our blog, usage and statistic information may be sent to Wordpress (Automattic) and affiliates, as well as Jetpack and Google Analytics. 

HOW LONG WE RETAIN YOUR DATA / DATA RETENTION

USER DATA

If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.

For users that register on our website (if any), or otherwise use the Twii application, we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their user identifier). Website administrators can also see and edit that information. Other platform users may see a subset of the information as required for the function of the application.

COOKIES

Cookies are files with a small amount of data that are commonly used as anonymous unique identifiers. These are sent to your browser from the websites that you visit and are stored on your device's internal memory.

This Service only uses cookies explicitly if you are logged in to Twii. We may also use third party code and libraries that use “cookies” to collect information and improve their services. By continuing to use our service, you are agreeing to your acceptance of the storage of these cookies on your device.

When you login to Twii as a user, we will store a unique identifier on your device, which may be in the form of a cookie, or other local storage method. This cookie will be retained until you initiate a log out from the device. If no application action is made by the user on the device for a period of time, the cookie may be deleted automatically, in which case you will have to log in again. If an update to the Twii application is performed, you may have to log in again. If you change your password, and choose to ‘log out all devices’, all devices except for or including the one you are changing your password from will be logged out upon the next application request for user data. 

If you log in, we will also set up several cookies to save your login information and your session preferences. Login cookies last for two days. If you select “Remember Me”, your login will persist for two weeks. If you log out of your account, the login cookies will be removed.

LOG DATA

Whenever you use our Service (including our website), in a case of an error in the app or otherwise in the course of general usage of our services, we collect data and information (through third party products) on your phone called Log Data. This Log Data may include information such as your device Internet Protocol (“IP”) address, device name, operating system version, the configuration of the app when utilizing our Service, the time and date of your use of the Service, and other statistics.

Log Data is retained for 90 days. If you are a normal user of Twii, application diagnostics and usage info may be logged and stored on our servers or in our database for up to 90 days after the usage activity in question. This log data is used to improve the performance of Twii, fix problems and bugs, and ensure the continued security of the Twii platform, as well as identify malicious actors. Some of the retained log data may contain identifiable user information, including, but not limited to, your full name, phone number, email address, device identifiers and fingerprint, actions and interactions within the application, and crash report information. This information may be accessible to the Twii administration team. If you are a beta tester of Twii, additional user data may be retained, and it may be retained for a longer period – up to 365 days. This information may be accessible to the Twii development team. The additionally retained information may include, but is not limited to: location information, device performance information, hashed session identifier information, or other user supplied information. 

WHAT RIGHTS YOU HAVE OVER YOUR DATA

Request deletion of your data from the platform

From within the Twii application, a user may request that their account and all associated user data and provided information be deleted from the platform. When a request for deletion is made, the user data will be retained for 90 days, during which the user may cancel the deletion request by logging into the platform and selecting the option to reactivate their account. After the 90 days has elapsed, the account can no longer be recovered.

Request a copy of your data after requesting deletion and within 90 days

If you have requested deletion from the platform, you may also request a copy of all user data Twii currently has relating to your profile or account. You may request this information by contacting us via one of the methods detailed in the ‘Contact Us’ section. We are only able to provide this information before the 90-day deletion window has elapsed, after which all associated information is forever irretrievable. Additionally, due to technical limitations, we are unable to supply a complete copy of user information for an account unless a request for deletion has first been requested by that user- so that user data can no longer be created in the report's interim generation period.

EXTERNAL LINKS & EMBEDDED CONTENT

External links linked to from here may contain tracking or referral information, collected for statistics or referral marketing program purposes. If you click on a third-party link, you will be directed to that site. Note that these external sites are not operated by us. Therefore, we strongly advise you to review the Privacy Policy of these websites. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.

Pages on the Twii website or within the application may include embedded content (e.g. videos, images, articles, etc.). Embedded content from other websites behaves in the exact same way as if the visitor has visited the other website.

These websites may collect data about you, use cookies, embed additional third-party tracking, and monitor your interaction with that embedded content, including tracking your interaction with the embedded content if you have an account and are logged in to that website.

CHILDRENS PRIVACY

The Twii platform is for adults. Users under the age of 18 are prohibited from using or registering for Twii. If a user is suspected of misrepresenting their date of birth, whether to falsely gain access to Twii as a minor, or whether to mislead other platform users, the user may be suspended from the platform pending verification of their date of birth, or altogether removed from the platform. Twii has a zero-tolerance policy for any misrepresentation of your date of birth. If you are a parent or guardian and you are aware that your child has provided us with personal information, please contact us to have the account deleted.

 

TERMS OF USE

SCOPE & APPLICABILITY

By downloading or using the app, these terms will automatically apply to you – you should make sure therefore that you read them carefully before using the app. You’re not allowed to copy, or modify the app, any part of the app, or our trademarks in any way. You’re not allowed to attempt to extract the source code of the app, and you also shouldn’t try to translate the app into other languages, or make derivative versions. The app itself, and all the trade marks, copyright, database rights and other intellectual property rights related to it, still belong to FoxTrot AeroWorks.

We are committed to ensuring that the app is as useful and efficient as possible. For that reason, we reserve the right to make changes to the app or to charge for its services, at any time and for any reason. We will never charge you for the app or its services without making it very clear to you exactly what you’re paying for.

The Twii.Club app stores and processes personal data that you have provided to us, in order to provide our Service. It’s your responsibility to keep your phone and access to the app secure. We therefore recommend that you do not jailbreak or root your phone, which is the process of removing software restrictions and limitations imposed by the official operating system of your device. It could make your phone vulnerable to malware/viruses/malicious programs, compromise your phone’s security features and it could mean that the Twii.Club app won’t work properly or at all.

With respect to our responsibility for your use of the app, when you’re using the app, it’s important to bear in mind that although we endeavor to ensure that it is updated and correct at all times, we do rely on third parties to provide information to us so that we can make it available to you. FoxTrot AeroWorks accepts no liability for any loss, direct or indirect, you experience as a result of relying wholly on this functionality of the app.

At various times, we may wish to update the app. The app is currently available via the web and on Android & iOS – the requirements for both systems(and for any additional systems we decide to extend the availability of the app to) may change, and you’ll need to download the updates if you want to keep using the app. FoxTrot AeroWorks does not promise that it will always update the app so that it is relevant to you and/or works with the Android & iOS version that you have installed on your device. However, you promise to always accept updates to the application when offered to you, We may also wish to stop providing the app, and may terminate use of it at any time without giving notice of termination to you. Unless we tell you otherwise, upon any termination, (a) the rights and licenses granted to you in these terms will end; (b) you must stop using the app, and (if needed) delete it from your device.

 

TERMS OF SERVICE

By signing up for or using Twii, you are inherently and explicitly agreeing to all of the above and below policies, conditions, and terms. This includes, but is not limited to, the Twii Privacy Policy, Twii Terms Of Use, Platform Trust and Abuse Policy, and any other changes that may be required to ensure our continued compliance at a later time.  

VOLUNTARY USAGE RIGHT

Twii is an opt-in service. Users have the right to delete their account at any time. If you are dissatisfied with the Twii platform, you are encouraged to delete your account. If you encounter an abusive user on Twii, you are encouraged to report them within the platform.  

If you are an abusive user of Twii or are otherwise reported by another user of Twii, your user details may be visible to the Twii administration team, including the reported conversation, or user profile information. If you are found to be in violation of these Terms of Use, your account may be temporarily suspended, or permanently banned, in which case your voluntary usage right is revoked. 

If your account is deleted for any reason, your data will be retained for 90 calendar days, after which it will be permanently purged from our database. Data is retained for 90 days to aid in the resolution of potential pending abuse reports, or in case of user-initiated recovery. Users may recover their account prior to the aforementioned 90 days by logging into Twii. Deleted accounts cannot be recovered after 90 days.  If your account is banned, additional user information may be retained after 90 days. This information may include your phone number or unique device identification information in order to prevent your re-registration on Twii. This information may be retained indefinitely, in accordance with local legislature. 

POPULATED ACCOUNT REQUIREMENT & VERIFICATION

For a better experience for all users of the platform, while using our Service, we may require you to provide us with certain personally identifiable information, including but not limited to First Name, Last Name, Phone Number, Email Address, Date of Birth, Current and Recent Locations, details entered by the user into their profile, messages made through the app, uploaded pictures, interaction information, app usage information. The information that we request will be retained by us and used as described in this privacy policy.

Users may provide a verification image of themselves taken with their camera, for account confirmation purpose. If a verification image is provided, it will be visible to Twii administrators for the entirety of the existence of the account. If a verified account is later found to be dissimilar to the verified photo, you may be requested to verify your account again. If we reject your verification photo, we may request you upload another one in order to verify your account. Verification is optional, except in cases where we may suspect or a user has reported your account for misrepresentation of information. Profiles verified on Twii will display an additional verification checkmark beside the profile, to confirm your verified status to other users.

MISREPRESENTATION OF INFORMATION

Any users who are suspected of misrepresenting their information on the platform may be suspended, banned or immediately removed from the platform, at our discretion, with no notice. Users may also be requested to verify their information internally with a Twii platform administrator, in order to continue their usage of their account, at our discretion.

UPLOADED USER MEDIA

If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Though EXIF data removal is implemented through technological means upon picture upload, we cannot guarantee the complete expungement of all identifiable information. Visitors to the website may be able to download and extract any location data from images on the website. The responsibility of removing identifiable information from pictures uploaded to the platform rests solely with the user.

By uploading images to your Twii user account profile, you consent to their display on our platform, to other users, to their public visibility at our discretion, or to our removal in accordance with our privacy policy, terms of use, or for any reason, at our sole discretion.

Users retain all rights to their uploaded content, but Twii retains the right to display, use, and reproduce user uploaded media and data for marketing purposes, platform usage functionality, or other necessary application.

PURCHASES & REFUNDS

Twii is a free service. In exchange for your usage of Twii, you consent to the display of ads on platforms where purchases cannot or have not been made by the current user.  

Purchases made on the Twii application are non-refundable. Purchased user credits, once applied to your account, cannot be reversed. If you violate our terms of use, resulting in banning or removal from our platform, you inherently and explicitly forfeit all remaining purchased user credits. 

Users cannot make purchases through the web-based client, but can redeem them. In order to redeem them, credits must be purchased via a purchase-supported platform. Users who have made no purchases consent to the display of ads within the Twii client.

SECURITY & MALICIOUS ACTION

Any users found or suspected of attempting to defeat the built-in security of the platform, act maliciously on the platform, circumvent verification or security measures on our platform, or otherwise act maliciously or without good faith on the Twii platform, may be subjected to suspension, removal, or deletion at our discretion, with no notice.

User security tokens are stored in our database as either a salted hash, or a unique user reference token, depending on your method of login. Your plain text password cannot be recovered, and as such, resetting your password necessarily requires changing your password. To reset your password, you will need access to the phone number you created your account with. If your phone number has changed, you will need access to the verified email connected to your account. If you no longer have access to the phone number you created your account with, no longer know your password, and either did not have a verified email or do not have access to it, you will have to create a new account.

ACTION & DISCRETION ON THE PLATFORM

Your usage of the Twii platform implies an inherent agreement to act within the platform rules as detailed below:

  1. Use the Service for any purpose that is illegal or prohibited by this Agreement.
  2. Use the Service for any harmful or nefarious purpose.
  3. Use the Service in order to copy or imitate our product.
  4. Violate our Terms Of Use, as updated from time to time.
  5. Spam, solicit money from, or defraud any members.
  6. Impersonate any person or entity or post any images of another person without his or her permission.
  7. Bully, "stalk", intimidate, assault, harass, mistreat or defame any person or platform user.
  8. Post any Content that violates or infringes anyone's rights, including rights of publicity, privacy, copyright, trademark or other intellectual property or contract right.
  9. Post any Content that is hate speech, threatening, sexually explicit or pornographic.
  10. Post any Content that incites violence; or contains nudity or graphic or gratuitous violence.
  11. Post any Content that promotes racism, bigotry, hatred or physical harm of any kind against any group or individual.
  12. Solicit passwords for any purpose, or personal identifying information for commercial or unlawful purposes from other members or disseminate another person's personal information without his or her permission.
  13. Use another member's account, share an account with another member, or maintain more than one account.
  14. Create another account if we have already terminated your account, unless you have our permission.

We reserve the right to investigate or terminate your account without a refund of any credits if you have violated this Agreement, misused the Service or behaved in a way that we regard as inappropriate or unlawful, or in violation of this policy or related terms, to the extent of and including actions or communications that occur on the Twii platform.

You agree to use caution in all interactions with other members, in all cases. In addition, you agree to review and follow our platform rules prior to using the service.

You are solely responsible for your interactions with other members. You understand that we do not conduct any background checks on its members or otherwise inquire into the background of its members.

ABSOLUTELY NO REPRESENTATION OF WARRANTY & LIMIT OF LIABILITY

We make no representation or warranty as to the conduct of members.

There is no warranty for the program, to the extent permitted by applicable law. Except when otherwise stated in writing the copyright holders and/or other parties provide the program "as is" without warranty of any kind, either expressed or implied, including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose. The entire risk as to the quality and performance of the program is with you. Should the program prove defective, you assume the cost of all necessary servicing, repair or correction.

In no event unless required by applicable law or agreed to in writing will any copyright holder, or any other party who may modify and/or redistribute the program as permitted above, be liable to you for damages, including any general, special, incidental or consequential damages arising out of the use or inability to use the program (including but not limited to loss of data or data being rendered inaccurate or losses sustained by you or third parties or a failure of the program to operate with any other programs), even if such holder or other party has been advised of the possibility of such damages.

CHANGES TO POLICY & TERMS

We may update our Terms and Conditions from time to time. Thus, you are advised to review this page periodically for any changes. We will notify you of any changes by posting the new Terms and Conditions on this page. Changes to this policy or these terms will be posted above the current terms and conditions, at this URL; and will be posted for seven (7) calendar days before coming into effect. Your continued usage of the Twii platform implies inherent acceptance of any changes or revisions to this policy or the included terms, for any reason, including as necessary to maintain compliance with regulating authorities, update features or the security of the Twii application, or for any other reason, solely at our discretion.

PLATFORM TRUST & ABUSE

 

GENERAL

We act to maintain Twii as an open and welcoming platform free from discrimination and abuse. If we find you to be in violation of the privacy policy, terms of use, or our platform rules as described above, we may suspend, ban, or delete your account at our discretion. If you believe another user of the platform is violating our terms, policy, or conditions, you are encouraged to report their profile from within the application, where our administrators will take prompt action to initiate a resolution.

FILE A COMPLAINT

If you wish to file a complaint, whether about Twii, our platform, application, or content, you may do so by contacting us.

REPORTING PLATFORM ABUSE

Platform abuse should be reported from within the Twii Application. If you have encountered an abusive user on the application, you may report their profile, or your conversation with them. Upon a report of abuse, the Twii administration team will act if a violation is deemed to have occurred. If you have been banned from the Twii application and wish to contest your ban, you may do so once. If your ban contest is denied, you may not further appeal your ban.

CRIMINAL ACTIVITY

If you are law enforcement personnel and need to make a request in pursuit of a criminal investigation, please contact us. Include your badge number, verification photo, and case number or relevant case reference number. 

REPORTING NETWORK ABUSE

Suspected Network Abuse coming from Twii should be brought to our attention via email. Our servers will not make requests, on any protocol except HTTP or SMTP. Even then, if you are not expecting to see these transmissions from our network, as you do not believe you are an endpoint supporter of any Twii users, or believe these connections are erroneous for any other reason, please contact us. If you are contacting us to report suspected or known network abuse, please preface your message subject with “[NET ABUSE]” and include all relevant details required for identification and resolution of the problem on our end, including log files of connection requests, packet capture data, or other information at your discretion.

REPORTING COPYRIGHT MATERIAL

If you are the owner of copyrighted material you believe to be available on the Twii platform, whether user uploaded or built in to the application core, please notify us via one of the contact methods below and we will remove it.

REPORTING BUGS

Suspected or verified bugs in the Twii application, website, or other related services may be reported via one of the methods below. If your bug is confirmed as existing, we will reward you with 5% of the monthly gross profit of the Twii platform, split between all bug reporters within a calendar month.
